1. This agreement

These terms are between you and Analog Endurance ("Analog Endurance", "we", "us" or "our"), a sole proprietorship operating from Colorado, United States. Contact: [email protected]. They apply to analogendurance.com and the training plan builder at /plan-builder/, together the "Service". Using the Service means you accept them. If you do not accept them, do not use it.

Our Privacy Policy explains what happens to information you give us, and forms part of these terms.

You must be 18 or older to use the Service. If you are under 18, do not use it and do not buy anything through it.

The Service is offered to users in the United States only. It is not directed at, and is not offered to, users in the European Union, the United Kingdom or any other territory. If you are outside the United States, please do not use the Service. We may add other territories later, and these terms will be updated when we do.

2. What the service is

Analog Endurance turns a training plan into a printable wall calendar. You can write your own plan into it, or upload one you already have and let us read it in. There is no account and no sign-up.

Building and printing at home is free. Two things are sold:

• A print-ready digital file of your plan, carrying premium race artwork, delivered as a download.
• A printed poster of your plan, produced and shipped to you.

Both are sold and fulfilled by Fourthwall, not by us. See section 6.

The plan itself lives in your browser while you build it. We do not keep a copy, so closing the tab loses your work. Print it or save it before you go.

3. Not medical or coaching advice

This is important, and it is the reason this section is near the top.

Analog Endurance is a design tool. It lays out a training plan that you supply or write yourself, and prints it beautifully. It does not create training advice, it does not assess whether a plan suits you, and it does not adapt to your fitness, your injuries, your age or your health. Nothing on this site is medical advice, physiotherapy, diagnosis, treatment or professional coaching, and no relationship of that kind is created by using it.

Distance running carries real risk of injury and, rarely, of serious harm. Deciding what to run and when is yours. Talk to a doctor before starting or changing a training programme, particularly if you have a health condition, are returning from injury, are pregnant, or have not trained in some time. Stop and seek medical attention if something is wrong.

Where a plan came from someone else, whether a coach, a book, an app or a website, the advice in it remains theirs and any question about it belongs to them.

4. Plans you upload

You must have the right to upload what you upload. Many training plans are copyrighted works belonging to a coach, a publisher, a race or a training service. By uploading a file you confirm that you own it, or that you have permission to use it, or that using it in this way is otherwise lawful. You are responsible for complying with any licence, subscription terms or other restrictions that apply to a plan you obtained from another person or service.

This is exactly why nothing is stored. We do not want a library of other people's copyrighted plans and we have not built one. An uploaded file is read once, in memory, and is never written to a disk, a database or a backup. Section 3.1 of the Privacy Policy describes the path in full, including that the file is sent to Google to be read.

You keep every right you had in the file you upload. You give us permission to process it only for the purpose of building your plan on that visit, and only for as long as that request takes. We claim no other licence, and we do not use uploads to improve any product.

Do not upload anything unlawful, anything containing another person's private information, or anything you would not want a document reader to see.

If you believe something has been used here in breach of your copyright, write to us at [email protected] with enough detail to identify the work and where you saw it, and we will look into it promptly. We do not host or publish material submitted by users, so there is nothing here for us to take down on request, but we will act on anything brought to our attention.

5. Accuracy of what we read

Reading a plan out of a PDF, a photograph or a screenshot is done automatically by a machine learning model. It is imperfect, and it will sometimes be wrong. A workout can be shortened, put on the wrong day, or lost. The builder marks the squares it could not vouch for, but those marks catch some mistakes and not all of them.

The Service is not a substitute for reviewing your original training plan. Check the finished plan against your original before you print it, and before you train from it. Every square stays editable for that reason. A poster is printed exactly as you approved it, so a mistake you did not catch is a mistake that gets printed, and we cannot correct it afterwards.

The same applies to dates. Race dates shown in the builder, particularly ones marked as estimates, are our best information and are not official. Confirm the date with the race.

6. Buying a poster or a file

Paid products are purchased and fulfilled through Fourthwall. When you proceed to checkout, you leave the Analog Endurance website and are directed to a shop operated by Fourthwall, at analog-endurance-shop.fourthwall.com.

Fourthwall handles the applicable checkout, payment processing, order fulfilment, shipping, digital delivery and customer support associated with your purchase, and serves as the merchant of record for the transaction, which also means they calculate and remit any applicable sales tax.

Purchase-specific matters are governed by Fourthwall's own terms and policies. That includes payment, shipping, delivery, refunds, returns, customs, duties and digital delivery, all covered by the shop's own Terms of Service, Privacy Policy and Returns policy. Read those before buying. We do not restate them here, deliberately, because two documents describing one refund policy is how they come to disagree.

This division is the important part: Analog Endurance is responsible for the website, the builder and the artwork; Fourthwall is responsible for the transaction and its fulfilment. Nothing here makes Fourthwall responsible for the Service itself.

Two things worth knowing in advance: posters are made to order, and a print-ready file is delivered as a download that begins immediately. Both affect what can be returned, and Fourthwall's Returns policy is what governs it.

Prices shown inside the builder are for guidance. The price you pay is the one shown at Fourthwall's checkout, in your own currency, with shipping and tax as quoted there.

7. What we own, and what you get

Ours. The site, the builder, the layout and design of the printed sheet, the Analog Endurance name and mark, and every piece of watercolour artwork offered as a background are owned by us or licensed to us. They are not yours to copy, resell, redistribute or use to make something for sale.

Yours. Your training plan is yours. Nothing here gives us a claim over it.

What buying gives you. When you buy a print-ready file or a poster, you are buying that artifact with that artwork on it. That comes with a personal, non-exclusive, non-transferable licence to print and use it for your own training, as many times as you like. It does not include reselling it, redistributing the file, printing it for others commercially, or extracting the artwork for use elsewhere. It is personal use only. A coach, club or employer wanting copies for other people needs one purchase per person.

Free backgrounds print freely and always will. Where a premium background is selected, the artifact is a paid product, and a preview watermark on it is a technical measure rather than an invitation. Removing or circumventing it to obtain the paid artifact without paying is a breach of these terms.

8. Acceptable use

You agree not to:

• Use the upload endpoint automatically, in bulk, or in any way designed to get around its rate limits or its bot check.
• Use the Service to process documents at scale for someone else, or to build a competing product.
• Attempt to interfere with, overload, probe or gain unauthorised access to any part of the Service.
• Reverse engineer or circumvent any technical measure that gates a paid artifact.
• Upload anything unlawful, or anything you do not have the right to upload.
• Misrepresent Analog Endurance as the author of a training plan it merely printed.

Reading a plan costs us real money per upload, which is why these limits exist at all.

9. Availability and changes

The Service is offered as it is and as it happens to be available. We may change it, add to it, remove parts of it, or stop offering it, at any time and without notice. Features that are free today may not stay free. Backgrounds may be added or withdrawn. We are a small operation and there is no uptime commitment.

We may change these terms. If we do, we will update the date at the top of this page, and the change applies from the moment it is posted. Continuing to use the Service after that means you accept the change. Changes do not apply retroactively to an order already placed.

10. Disclaimer of warranties

The service is provided on an "as is" and "as available" basis, without warranty of any kind. To the fullest extent permitted by law, we disclaim all warranties, express, implied or statutory, including: any implied warranty of merchantability, fitness for a particular purpose, title, quiet enjoyment, or non-infringement; and any warranty arising out of course of dealing, usage or trade.

We do not warrant that the service will be uninterrupted, secure or error free, that any plan read from an uploaded document will be complete or accurate, or that any training plan produced with it is safe or suitable for you.

Some places do not allow the exclusion of implied warranties, so parts of this section may not apply to you.

11. Limitation of liability

To the fullest extent permitted by law, we will not be liable for any indirect, incidental, special, consequential, exemplary or punitive damages, or for any loss of profits, revenue, data, goodwill, or for personal injury arising out of your training, in each case however caused and regardless of the theory of liability, even if we have been advised of the possibility of such damages.

Our total aggregate liability arising out of or relating to these terms or the service will not exceed the total amount you paid us in the twelve months before the claim arose.

Nothing in these terms limits liability that cannot be limited by law, including liability for death or personal injury caused by negligence, or for fraud. The limitations in this section apply even if a limited remedy fails of its essential purpose. Some places do not allow certain limitations, so parts of this section may not apply to you.

12. Indemnity

You agree to indemnify and hold us harmless from any claim, demand, loss or expense, including reasonable legal fees, arising out of your use of the Service, your breach of these terms, or any content you upload, including a claim that a plan you uploaded infringed someone else's rights.

13. Termination

You can stop using the Service at any time, and because there is no account there is nothing to close. We may suspend or block access to the Service, in whole or in part, if these terms are being breached or if the upload endpoint is being abused.

Sections 3, 4, 5, 7, 10, 11, 12 and 14 survive the end of this agreement.

14. Governing law and disputes

These terms are governed by the laws of the State of Colorado, United States, without regard to its conflict of laws rules. The state and federal courts located in Colorado have exclusive jurisdiction over any dispute arising out of or relating to these terms or the Service, and you and we each consent to that jurisdiction and venue.

Fourthwall's own terms select a different state for the purchase itself. That is expected: those terms govern the transaction with Fourthwall, and these terms govern your use of Analog Endurance. Section 6 sets out which is which.

15. General

These terms, together with the Privacy Policy, are the entire agreement between us about the Service. If any provision is found unenforceable, the rest stays in force. Our not enforcing a provision is not a waiver of it. You may not assign these terms; we may assign them as part of a transfer of the business.

Purchases are governed by Fourthwall's terms as described in section 6. Where those terms and these terms cover the same subject, theirs govern the transaction and these govern the Service.
